Not sure if they are or aren't, I couldn't find the .pot file to take a look there.

These are not related. They are two separate issues.
Terms of Use is set to be translated, as found in the .pot file:
http://cosl.usu.edu/trac/browser/trunk/eduCommons/eduCommons/i18n/plone.pot
The other issue is an enhancement, and should be entered in a separate ticket as such.

Related, should the title of the link be drawn from the page Title as set in the edit tab, as for "Terms of Use", if I change the page title to "Use Terms"?
